Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Goycho's website, progressive web app, and related services (the "Service"). By creating an account, placing an order, applying as a Pilot or vendor partner, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Goycho is a marketplace platform that helps customers discover and order from local restaurants, home kitchens, bakeries, and village shops in Goa, and connects those orders with independent delivery partners ("Pilots"). Unless expressly stated otherwise, vendors prepare and sell the goods, Pilots perform delivery, and Goycho provides the technology and coordination layer. Availability of vendors, delivery areas, and estimated times may vary by village, weather, and partner capacity.

3. Accounts & eligibility

• You must be at least 18 years old to use the Service.
• You are responsible for keeping your login credentials secure.
• Information you provide (including delivery address and phone number) must be accurate and kept up to date.
• We may suspend or terminate accounts that violate these Terms, harm other users, or create safety or fraud risk.

4. Orders, pricing & cancellations

When you place an order, you offer to purchase the listed items at the displayed prices plus applicable delivery fees, platform fees, taxes, and tips. Vendors may accept, reject, or mark items unavailable. Order confirmation is subject to vendor acceptance and Pilot availability.

Cancellation policies may depend on order status. Once a kitchen has accepted or begun preparing an order, cancellation or refund may be limited. If an item is unavailable or an order cannot be fulfilled, we or the vendor may cancel and arrange a refund or alternate resolution where appropriate.

5. Payments

You authorize Goycho and its payment partners to collect amounts due for your orders using the payment method you select (including UPI intents / QR flows and cash on delivery, where offered). You are responsible for ensuring sufficient funds or successful payment authorization. Failed, incomplete, or disputed payments may result in order cancellation or collection of outstanding amounts.

Payment processing may be handled by third-party providers. Goycho does not store full card numbers or UPI PINs. See our Privacy Policy for more detail on payment data handling.

6. Location & device permissions

Certain features—such as village suggestions, delivery mapping, live order tracking, and Pilot navigation—may request access to your device location, microphone (for optional voice ordering), or notifications. You can decline or revoke these permissions, but some features may then be unavailable or less accurate. You agree not to misuse location or tracking features.

7. Vendor & Pilot partners

If you register as a vendor or Pilot, you agree to provide accurate onboarding information, comply with applicable food-safety, transport, and licensing rules, and fulfil accepted orders diligently. Partner access may require verification. Misrepresentation, unsafe conduct, or repeated fulfilment failures may result in removal from the platform.

8. Acceptable use

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes
• Interfere with platform security, rate limits, or other users' accounts
• Scrape, reverse engineer, or misuse voice / AI features beyond intended use
• Harass vendors, Pilots, customers, or Goycho staff

9. Food quality & allergies

Food is prepared by independent vendors. Descriptions, photos, ratings, and estimated times are provided for convenience and may not always be exact. If you have allergies or dietary restrictions, verify ingredients directly with the vendor where possible. Goycho is not the manufacturer or cook of the food sold through the marketplace.

10. Disclaimers & liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Goycho disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, exact delivery times, or error-free maps or voice recognition.

To the fullest extent permitted by law, Goycho's total liability arising out of or related to the Service shall not exceed the greater of (a) the amounts you paid through Goycho for the order giving rise to the claim, or (b) INR 2,000. Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.

11. Indemnity

You agree to indemnify and hold harmless Goycho and its operators from claims, damages, and expenses arising from your misuse of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing law

These Terms are governed by the laws of India. Courts in Goa shall have exclusive jurisdiction, subject to any mandatory consumer-protection rights that apply to you.

13. Changes

We may modify these Terms from time to time. Material changes will be reflected by updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
